End User License Agreement (EULA) for Q Virtual Amp

Effective Date: April 6, 2026

This End User License Agreement ("Agreement") is a legal agreement between you and Herb Design Group ("Herb Design Group," "we," "our," or "us") for the use of Q Virtual Amp and any related updates, installers, and documentation (collectively, the "Software").

By installing, activating, or using the Software, you agree to this Agreement.

1. License Grant

Subject to this Agreement and payment of any applicable fees, Herb Design Group grants you a limited, non-exclusive, non-transferable, non-sublicensable license to install and use the Software for your personal use or your internal business use.

This license is granted to you, not sold to you.

2. License Activation

Some features of the Software may require a valid purchased license. License purchases and license activation are handled through Polar.sh.

By activating the Software, you understand that:

  • a valid license key may be required to unlock the full pedalboard features;
  • the Software may contact Polar.sh to validate or activate your license; and
  • your use of Polar.sh is also subject to Polar.sh's own terms and privacy practices.

3. Permitted Use

You may:

  • install and use the Software on devices you own or control;
  • make a reasonable backup copy for archival purposes; and
  • use saved pedalboard files and presets for your own lawful purposes.

4. Restrictions

You may not, except as permitted by applicable law:

  • copy, distribute, sell, lease, rent, sublicense, or transfer the Software;
  • reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying logic of the Software;
  • remove or alter proprietary notices, branding, or license protections;
  • use the Software in violation of any law or regulation; or
  • share, bypass, or misuse license keys or activation mechanisms.

5. Ownership

The Software is proprietary and is owned by Herb Design Group. All rights not expressly granted to you are reserved.

6. Updates and Changes

We may release updates, bug fixes, improvements, or new versions of the Software. Some updates may require you to download a newer release or revalidate your license.

7. Refunds

If you purchased a license through Polar.sh, refunds are available within 14 days of purchase, subject to applicable law and the payment platform's processing requirements. To request help with a refund, contact support@herbdesigngroup.com.

8. Termination

This Agreement remains in effect until terminated. It will automatically terminate if you violate this Agreement. Upon termination, you must stop using the Software and delete all copies in your possession or control.

9. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

We do not guarantee that the Software will be uninterrupted, error-free, or compatible with every device, operating system, or audio setup.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HERB DESIGN GROUP WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE SOFTWARE OR THIS AGREEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HERB DESIGN GROUP'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SOFTWARE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE LICENSE GIVING RISE TO THE CLAIM.

11. Governing Law

This Agreement is governed by the laws of Pennsylvania, United States, without regard to conflict of law principles. Any dispute relating to this Agreement or the Software will be brought in the state or federal courts located in Pennsylvania, and you consent to that venue and jurisdiction.

12. Changes to This Agreement

We may update this Agreement from time to time. The most current version will govern future use of the Software after publication.
