Terms of Service for Q Virtual Amp

These Terms of Service ("Terms") govern your access to and use of Q Virtual Amp, related downloads, our website, and associated purchase or license pages offered by Herb Design Group ("Herb Design Group," "we," "our," or "us").
By accessing, purchasing, downloading, activating, or using Q Virtual Amp, you agree to these Terms.
1. Eligibility
You may use Q Virtual Amp only if you can form a binding contract under applicable law and use the Software in compliance with these Terms and all applicable laws.
2. What We Provide
Q Virtual Amp is a guitar and audio effects application that allows users to build and manage pedalboard-style sound setups, use built-in utility tools such as a tuner and metronome, and save or load pedalboard configurations.
3. Purchases and Payments
Licenses for Q Virtual Amp may be sold through Polar.sh. Pricing, taxes, checkout processing, and payment handling may be managed by Polar.sh or its payment partners.
By placing an order, you agree that:
- you will provide accurate payment and contact information;
- you are authorized to use the payment method provided; and
- your purchase may be subject to Polar.sh's terms, payment processing rules, and fraud-prevention checks.
4. Refund Policy
Refunds are available within 14 days of purchase, subject to applicable law and any required processing through Polar.sh or the payment provider.

5. License and Acceptable Use
Your use of the Software is also governed by the accompanying End User License Agreement (EULA).
You agree not to:
- misuse the Software or any license key;
- interfere with or attempt to bypass licensing or security features;
- resell, redistribute, or commercially exploit the Software except as expressly authorized;
- use the Software for unlawful, harmful, or infringing purposes; or
- attempt to reverse engineer or copy the Software beyond what applicable law permits.
6. Intellectual Property
Q Virtual Amp, including its software, branding, design, documentation, and related content, is owned by Herb Design Group and protected by intellectual property laws. These Terms do not transfer ownership to you.
7. Third-Party Services
Certain parts of the customer experience may rely on third-party services, including Polar.sh for storefront and licensing and GitHub for update-release information. Those services operate under their own terms and privacy policies.
8. Disclaimer
Q Virtual Amp is provided "as is" and "as available" to the maximum extent permitted by law. We do not guarantee uninterrupted operation, error-free performance, or compatibility with every hardware or software environment.
9. Limitation of Liability
To the maximum extent permitted by law, Herb Design Group will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, revenue, or business opportunity resulting from your use of or inability to use Q Virtual Amp.
To the maximum extent permitted by law, our total liability for any claim arising from these Terms or the Software will not exceed the amount you paid to us for the applicable license.
10. Suspension or Termination
We may suspend or terminate access to licensed features if you violate these Terms, misuse the Software, or use invalid or unauthorized license credentials.
11. Changes to These Terms
We may update these Terms from time to time. Updated Terms will apply prospectively after they are posted or otherwise made available.
12. Governing Law
These Terms are governed by the laws of Pennsylvania, United States, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Pennsylvania.
